FlexiPay Promotion for £50 John Lewis & Partners E-Gift Card - November 2024

1 - This promotion is available to existing FlexiPay customers who receive a feedback call from Funding Circle Ltd (“Funding Circle”) from 09.00 on 20/11/2024

2 - The promotion is open from the date of the receipt of the feedback call until 23.59 on 15/12/2024 (the “Promotion Period”).

3 - Qualifying Criteria: to qualify for a £50 John Lewis Gift Card*:

3.1 - You must have an open FlexiPay account;

3.2 - You must complete at least one transaction by making transfers via the FlexiPay portal or payments on your FlexiPay card within the Promotion Period.

3.3 - The transactions must be completed successfully within the Promotion Period and any successfully completed payments before the end of the Promotion Period will be honoured.

3.4 - You must not have any overdue repayments owed to Funding Circle at the end of the Promotion Period and must have an active direct debit set up.

3.5 - Any payee must be wholly independent of your business and must not be linked to the repayment of your Funding Circle finance.

4 - Customers who meet the qualifying criteria will receive a John Lewis & Partners E-Gift Card worth £50.

5 - The John Lewis & Partners E-Gift Card will be emailed to your registered email address. It is your responsibility to ensure your contact details are up to date. Funding Circle will aim to do so by 24th December 2024 or in any event, as soon as reasonably practicable, in line with internal processes. Funding Circle accepts no liability for any delay in delivery of the John Lewis & Partners E-Gift Card.

6 - Funding Circle accepts no responsibility for transactions or card payments not successfully completed due to a technical fault, computer hardware or software failure, or satellite, network or server failure of any kind.

7 - The John Lewis & Partners E-Gift Card is not transferable for a cash alternative.

8 - The promotion is limited to a maximum of one John Lewis & Partners E-Gift Card worth £50 per FlexiPay account. Only the email address associated with the FlexiPay account may redeem the John Lewis & Partners E-Gift Card. The promotion cannot be transferred to a third party.

9 - Funding Circle reserves the right to amend or extend any or all elements of this promotion at any time by giving notice by email or on the Funding Circle website.

10 - Funding Circle reserves the right to refuse an award where there are reasonable grounds to believe there has been a breach of these terms and conditions, the FlexiPay terms and conditions, any instruction forming part of this promotion or where abuse is suspected. Funding Circle will be the final arbiter in any decisions and its decision is final and binding in all matters.

11 - By participating in this promotion, participants are deemed to have accepted these terms and conditions.

12 - Funding Circle does not accept any liability in respect of any goods acquired with the John Lewis & Partners E-Gift Card.

13 - These terms and conditions are governed by and construed in accordance with English law and subject to the exclusive jurisdiction of the English courts.

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the terms and conditions and by participating all claimants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy of these Terms and Conditions for your information.

1 - Promoter: Funding Circle Ltd, 71 Queen Victoria Street, London EC4V 4AY. Premiership Rugby is not the Promoter and is not responsible for the administration of the promotion.

2 - Who can enter: The competition is open to all UK residents of 18+ years of age who own a small or medium-sized business or who have the authority of the business owner (SME is defined as a limited company, sole trader or LLP currently trading in the UK, with fewer than 250 employees) with a minimum of 2 years trading activity before the competition opening date (7th November 2024) (“Eligible Business”).

3 - Ineligible Businesses and Individuals:

The following are ineligible for the purposes of this competition:

i. any official partner of Premiership Rugby;

ii. any business dealing in arms, adult entertainment, counterfeit products, drug paraphernalia or pseudo pharmaceuticals;

iii. charities and community interest companies;

iii. any unregulated money servicing businesses, cheque encashment agencies, bureau de change, and money transmitters;

iv. any business or individual guilty of financial misconduct, any individual with a criminal record, any business in bankruptcy, liquidation or similar and any business or individual with a significant adverse credit event against directors or shareholders of the business.

v. Funding Circle employees, their immediate families (spouse, parent, child, sibling, grandparent and/or "step" family), agencies or any third party directly associated with the promotion.

4 - By entering the competition, entrants confirm that they have read and agree to be bound by these Terms and Conditions and by the decisions of the Promoter.

5 - Entrants confirm that by entering the competition they have the business owner's permission to do so.

6 - Please note that the competition features across two entry forms with one shared prize pool.

7 - Promotional Period: The competition opens at 11:00AM GMT on 7th November 2024 and closes at 23:59 on 12th January 2025.

8 - How to enter:

b. Provide the required details on the form including your First Name, Surname, business email address, country of residence, business type, the name of your business, confirm that you are either an SME business owner or have the authority of the business owner, and choose a Premiership Rugby club from the below list of 10 clubs and set fixtures:

c. Winners and Runners-Up will be offered hospitality at home fixtures only.

d. Fixtures will be on the rounds listed above however specific dates and times of fixtures are subject to change.

e. In the box provided, describe in 100 to 200 words how the teamwork that helps your business operate successfully could be applied to benefit your choice of Premiership Rugby Club. Your entry must address the following judging criteria: how the strengths of your teamwork are crucial to your business success (40%), how the strengths of your teamwork would make a positive impact at your choice of Premiership Rugby Club (40%) and what you see as the crucial ingredient(s) for effective teamwork (20%).

f. There is a limit of one entry per Eligible Business to the competition. If you enter more than once, your first entry will be accepted, and all others will be disqualified.

g. Incomplete, illegal, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of delivery or receipt. The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.

h. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries or via third parties or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified. If it becomes apparent that a participant is using a computer(s) or multiple aliases to circumvent this condition by, for example, the use of 'script', 'brute force', masking their identity by manipulating IP addresses, using identities other than their own or any other automated means to increase that participant's entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that person's entries will be disqualified, and any award will be void.

i. Entries on behalf of another business will not be accepted, and we cannot accept joint submissions or collaborations.

9 - Content restrictions: Entries which, in the Promoter's sole discretion, breach any of the following restrictions will not be accepted:

a. entries which are sexually explicit or overly suggestive;

b. entries which promote any activities that may appear unsafe or dangerous;

c. entries which feature violent, derogatory, profane, vulgar, indecent, racist, or cruel content, including but not limited to words or symbols that might be considered offensive to individuals of any race, ethnicity, religion, sexual orientation or socioeconomic group;

d. entries which portray the Promoter or Promoter’s brands or products in any way that in the Promoter’s opinion may give rise to public contempt, scandal, disrepute or ridicule or that defame, misrepresent or contain disparaging remarks about the Promoter or other people or companies;

e. entries which communicate messages or images inconsistent with the positive images and/or brand values associated with the Promoter; and

f. We will not tolerate anyone who posts or is seen to be posting comments via any social media channel or anywhere else during this competition that we think is bullying, spiteful or upsetting to other entrants and followers of the Promoter or directly aimed at us. Anyone acting in this way will be disqualified from the competition.

10 - Shortlist selection:

a. A shortlist of 3 entries per Premiership Rugby Club choice which best meet the judging criteria (in clause 8e) will be compiled by a third-party agency and an independent person.

b. Shortlisted entrants may be contacted by a third-party by email (“Agents”, see clause 16) and required to provide such information as the Promoter may determine, in order to verify the entrant’s identity and compliance with these Terms and Conditions including but not limited to a proof of business trading history, proof of employment with the applicant business and a copy of a government-issued identification document. In the event a shortlisted entrant does not submit the required information or does not meet the competition eligibility criteria, they will be disqualified from the competition and will not progress to the Final Winner and Runners-Up Selection.

c. The Promoter reserves the right to complete checks on any information provided by the shortlisted entrants including both the entrant and its business for proof of identity, age and address. The Promoter reserves the right to withdraw shortlist entitlement, if the entry is deemed to be fraudulent or does not meet the eligibility criteria in clause 2 or is ineligible for the purposes of this competition in line with clause 3.

d. In the event that a shortlisted entrant is (in the opinion of Premiership Rugby and/or the relevant Premiership Rugby club) a competitor to any sponsor or partner of Premiership Rugby or the relevant Premiership Rugby club, then that shortlisted entrant shall not be eligible to be the first prize winner, but may still be considered by the judges for a Runner-Up prize

11 -Final Winner and Runners-Up Selection.

a. The shortlisted entries per Premiership Rugby Club choice will be judged by a judging panel including at least one person independent to the Promoter.

b. There will be one first prize winner (‘Winner’) in total and 9 Runners-Up prizes (‘Runners-Up’).

c. The Winner will be the entrant of 1 x Premiership Rugby Club choice, who in the opinion of the judges, best meets the judging criteria in Clause 8e from all shortlisted entries combined.

d. A Runners-Up prize (9 total) will be awarded to 1x entrant per remaining Premiership Rugby Club choice who in the opinion of the judges, best meets the judging criteria in Clause 8e.

e. In the event of a tie between one or more entries, the entrant that receives the highest score in ‘how the strengths of your teamwork are crucial to your business success’’ will be selected as the Winner, or Runner-Up. If a tie still remains, the participant that receives the highest score in ‘how the strengths of your teamwork would make a positive impact at your local Premiership Rugby Club’ will be selected and so on.

f. In the event that a tie remains after following the process in Clause 11e, the tied entrants will be placed into a random prize draw and the prize will be awarded to the first entrant drawn.

g. The Promoter in its absolute discretion reserves the right to not award a prize if there are not enough entries which meet the judging criteria per Premiership Rugby Club choice.

12 - Winner Notification: The Winner and Runners-Up will be notified by 14th February 2025 by email and a phone call with the details provided at the point of entry.

13 - Winner Claim:

a. The Winner has 5 working days from the date they were notified under clause 12 to accept their prize. If the Winner does not accept the prize within this timeframe, the prize will be forfeited, and if there are enough qualifying entries, awarded to the first Runner-up chosen at the same time as the original.

b. It is the responsibility of the entrants to provide their correct, up-to-date details when entering the competition and/or confirming acceptance of their prize. The Promoter will under no circumstances be held responsible for the Winner or a Runner-Up failing to supply accurate information which affects prize delivery or arrangements.

14 - The First Prize:

a. Hospitality for 10 people to watch a home fixture at the Premiership Rugby club and fixture chosen at the point of entry (excludes travel). The box includes food and beverage (up to £100 worth per person). There is no choice of fixture date, and the winner cannot change their Premiership Rugby club. The ticketing terms and conditions and any relevant venue regulations applicable to the relevant Premiership Rugby club shall apply to the winner’s use of the tickets.

b. LED stadium branding at the attended match (subject to approval by Premiership Rugby). The co-branded LED will be arranged by Funding Circle and Premiership Rugby. Branding consists of Sponsor Brands on the Perimeter System in thirty (30) second rotations for a total of 8 (eight) minutes.

c. Co-branded advertising in the chosen Premiership Rugby club match day programme (or digital equivalent (subject to a match day programme being produced).

d. The prize is as stated, and no cash or other alternative prize will be offered for the competition. No travel, medical or other insurance is included. The Winner is responsible for informing the Promoter of any wheelchair or similar access requirements when taking up the prize, and for ensuring they and their guests adhere to all applicable health and safety guidelines.

e. If the Winner is not able for whatever reason to accept their prize, then the Promoter reserves the right to award that prize, if there are enough qualifying entries, to the first Runner-Up chosen at the same time as the original.

f. The Promoter reserves the right to provide an alternative prize of equal or greater value should circumstances outside its control make this necessary.

15 - Runners-Up Prizes:

a. Each Runner-Up receives hospitality for 10 people to watch a home fixture at the Premiership Rugby club and fixture chosen at the point of entry (excludes travel, no choice of fixture date for selected club). There is no choice of fixture date, and a Runner-Up cannot change their Premiership Rugby club.

b. The ticketing terms and conditions and any relevant venue regulations applicable to the relevant Premiership Rugby club shall apply to the Runners-Up use of the tickets.

c. The prize is as stated, and no cash or other alternative prize will be offered for the competition. No travel, medical or other insurance is included. Each Runner-Up is responsible for informing the Promoter of any wheelchair or similar access requirements when taking up the prize, and for ensuring they and their guests adhere to all applicable health and safety guidelines.

d. If a Runner-Up is not able for whatever reason to accept their prize, then the Promoter reserves the right to award that prize, if there are enough qualifying entries, to a back-up chosen at the same time as the original.

f. The Promoter reserves the right to provide an alternative prize of equal or greater value should circumstances outside its control make this necessary

16. Data Protection

a. All personal data provided by entrants when entering the competition will be used by the Promoter for the purposes of administering and fulfilling the competition and always in accordance with the Promoter’s Privacy Policy here. The Promoter has engaged the services of Wasserman Digital and Data who have also engaged the services of Prizeology Limited (together, the “Agents”) to assist with the running of the competition, the collection and management of data and the selection of the Winner and Runners-Up. By entering into the competition, you consent to the Promoter’s use, which includes, the sharing of any personal data received for the purposes of the competition with the Agents:

b. Where you have indicated your consent to receiving communications from the Promoter about our products and/or services, as part of entering the competition:

i. Should your email address will be added to our electronic mailing list accordingly;

ii. Any personal data you provide will be processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 and associated laws;

iii. Your data will be processed in accordance with the Promoter’s Privacy Policy;

Iv. If you do not wish for your details to be used for marketing purposes, you can select the unsubscribe option in the emails that are sent to you at any time.

17 - General

a. The Promoter reserves the right at any time, in its absolute discretion, to:

i. Verify the eligibility of any entrant or winner; disqualify any entrant, Winner Or Runner-Up found to be abusing or tampering with the operation of the competition or entering using fraudulent means, or who the Promoter believes to have acted in breach of these Terms and Conditions or the spirit of the Promotion; and

ii. Disqualify an entrant, Winner or Runner-Up if they are found to be in breach of these Terms and Conditions. Where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, prize entitlement will be withdrawn, and if there are enough qualifying entries, awarded to a Runner-Up or back-up chosen at the same time as the original.

b. By entering the Promotion, each entrant grants the Promoter a world-wide, irrevocable, non-exclusive, transferable, royalty free and sub-licensable right and licence to use reproduce, modify, adapt, publish or display (in whole or in part) any intellectual property contained in the content of their entry, without royalty, payment or other compensation. Each entrant agrees not to assert any moral rights in relation to such use and warrants that they have full authority to grant such rights.

c. The Winner may be asked to take part in reasonable publicity relating to this prize draw without payment. Such publicity may include, without limitation, publishing the Winner’s surname and business name on the Promoter’s website or social media sites, their entry and any statements made by them concerning the Promotion and the prize won as part of the Promotion on the Promoter’s website, social media channels and via other third-party mainstream media or broadcast channels, being filmed at their business address, or creating content on behalf of the Promoter. This is not a condition of entry, and the Winner can refuse to participate in publicity.

d. Entrants acknowledge that other entrants may submit entries that may be similar to their own, and that they will not be entitled to any compensation or right to negotiate with the Promoter over such matters.

e. To the fullest extent permitted by law, neither the Promoter nor Agents involved with this promotion may be liable to the Winner or Runners-Up, whether arising from tort including negligence, breach of contract or otherwise for any loss or damage whatsoever caused by matters relating to participation in this promotion, or in relation to the award to the extent permissible by law. No compensation for loss of earnings will be paid by the Promoter for participation in any aspect of this promotion.

f. In the event of circumstances outside the reasonable control of the Promoter for whatever reason, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of the prizing, and only where circumstances make this unavoidable, the Promoter in its absolute discretion reserves the right to cancel, amend, terminate or temporarily suspend this promotion, with no liability to the Promoter, any entrants or third parties, but will use all reasonable endeavours to avoid entrant disappointment.

g. The Promoter’s decision is final and binding. No correspondence will be entered into.

h. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to, lost, delayed, or not received entries, winner notifications or awards. The Promoter or its Agents will not be responsible for the non-inclusion of entries as a result of technical failures or otherwise, including any such failure which is within the control of The Promoter or its Agents.

i. The surname and county of the Winner and Runners-Up will be made available to anyone who requests it by emailing Fundingcircle@loveprizes.co.uk by 1st March 2025. Entrants may request their surname and county is not published in the event they win by emailing Fundingcircle@loveprizes.co.uk before the closing date. However, the Promoter shall provide the surname and county of the winners to the Advertising Standards Authority on request.

j. The laws of England and Wales apply to this promotion, and the English and Welsh courts shall have exclusive jurisdiction over any proceedings in connection with this promotion.

k. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

1 - This promotion is available to existing Funding Circle customers who receive an email or outbound call inviting them to participate in the promotion from Funding Circle Ltd (“Funding Circle”) between 1st November 2024 and 30th November 2024 (dates inclusive).

2 - The promotion is open from the date of your receipt of the email or outbound call until 23.59 on 15th December 2024 (the “Promotion Period”).

2% Cashback on your spend up to the earlier of (i) the first £100,000 spent on your card (maximum cashback of £2,000); or (ii) the first six months following approval for a Funding Circle Cashback Business Credit Card (“Promotion”)

1 - This Promotion is available for borrowers six months following the borrower’s successful application for a Funding Circle Cashback Business Credit Card (the “Promotion Period”). For the avoidance of doubt, the Promotion Period commences from the date that you are approved for a Funding Circle Cashback Business Credit Card by Funding Circle following a successful application and ends six months after that date.

2 - This Promotion is available to any eligible Funding Circle borrower who successfully applies for a Funding Circle Cashback Business Credit Card and is approved up to and including the 31st December 2024.

3 - Funding Circle may accept or reject any applications for a Cashback Business Credit Card in its sole discretion

4 - No responsibility will be accepted for applications by borrowers that are ineligible, lost or delayed. 1% Cashback on eligible FlexiPay transactions for new customers in October 2024 (“Promotion”)

1 - These terms and conditions are supplemental to, and should be read in conjunction with, the Funding Circle Borrower Agreement and your FlexiPay credit agreement which you must agree to and accept before utilising your FlexiPay account. If there is any conflict or inconsistency between these terms and conditions and the Funding Circle Borrower Agreement and/or FlexiPay credit agreement, these terms and conditions shall take precedence.

2 - Unless otherwise stated, defined terms refer to those defined in the Funding Circle Borrower Agreement and your FlexiPay credit agreement. For the avoidance of doubt these terms and conditions are in addition to any other terms and conditions regarding your FlexiPay Account.

3 - This Promotion is available to customers who:

i. have not previously held a FlexiPay Account or Cashback card;

ii. have been notified by email that they are eligible to partake in the Promotion ; and

iii. open their FlexiPay Account by the 31st October 2024,

(“you”).

4 - This Promotion is open for eligible FlexiPay transactions up to and including the 31st December 2024 (“Promotion Period”). FlexiPay transactions made in the first 4 business days after the FlexiPay Account has been opened are not eligible for Cashback.

5 - During the Promotion Period, you will receive 1% cashback (“Cashback”) on eligible FlexiPay transactions applied as credit towards your cashback balance available in your FlexiPay Account (“Cashback Balance”) provided you pay the Amount Due (as detailed in your FlexiPay credit agreement and in your FlexiPay Account) by the relevant Due Dates.

6 - Cashback will be credited to your Cashback Balance once an eligible FlexiPay transaction has cleared. Further details of which payments are eligible are contained in your notification email.

7 - You will forfeit your total Cashback Balance if (i) you fail to pay any Amount Due by the Due Date (whether in connection with the Billing Period in which the Cashback was incurred or any subsequent Billing Period); and/or (ii) if you close your FlexiPay Account.

8 - Subject to clause 4 above, you will start earning Cashback on eligible FlexiPay transactions for the duration of the Promotion Period unless you inform us that you do not wish to participate in the Promotion.

9 - Cashback will be applied to your Cashback Balance in respect of Cashback earned in the previous Billing Period the day after we receive the Amount Due under your Repayment Plan provided such payment is made on or before the Due Date.

10 - We do not treat Cashback as a repayment towards your FlexiPay Balance. This means you still need to pay the Amount Due, regardless of any Cashback earned within the preceding Billing Period and/or applied in the current Billing Period.

11 - You may decide when you would like to use any or all of your Cashback Balance to reduce your total FlexiPay Balance by following the instructions in the FlexiPay portal and/or mobile app.

12 - Transactions that are reversed, refunded or cancelled are not eligible for Cashback and any Cashback credited to your Cashback Balance in respect of an ineligible transaction will be reversed.

13 - Your Cashback Balance will remain available to redeem against your FlexiPay Balance for a period of 12 months from the date you last earned Cashback.

14 - Funding Circle reserves the right to recover any Cashback from your Cashback Balance that was paid to you in error, resulted from your fraud, or resulted from you misusing or gaming the offer. If we reasonably suspect any fraud or misuse by you relating to Cashback, or if you breach these terms, we can disqualify you from earning future Cashback and any future promotions

15 - If you think you’re missing Cashback, you’ll need to tell us within 30 days from the date of the eligible FlexiPay transaction by emailing us on flexipay@fundingcircle.com.

1 - This promotion is available to businesses who are invited to apply for FlexiPay or the Cashback Card from Funding Circle Ltd (“Funding Circle”) and are offered this promotion.

2 - The promotion is open from 27/08/2024 until otherwise stated (the “Promotion Period”).

3 - Applicants who submit valid applications, are successful and open a FlexiPay or Cashback Card account will receive a John Lewis Gift Card* worth £25.

8 - The John Lewis Gift Card is not transferable as a cash alternative.

9 - The promotion is limited to a maximum of one John Lewis Gift Card worth £25 per FlexiPay account. Only the email address associated with the FlexiPay account or Cashback Card account may redeem the John Lewis Gift Card. The promotion cannot be transferred to a third party.
